Business dealing with father

Assalaa Alaikum,

Many years ago I started a business with my father in Pakistan. Alhumduliallah my father bought a lot of property and I paid for all the properties. Later my father sold a lot of the property, but never shared the profit with me. Once I noticed that I will not be given any profit from any property I stopped investing with my father. None of the properties that I paid for are in my name infact some of the properties that I paid for are in the name of my sisters. Later my father transfered a piece of property in my name that I paid for originally from my pocket and said that in 10 years from now this property will be equivalent to the amount of money you have invested with me. Also, the property that he transfered in my name had a loan that I had to repay worth 21 lakhs. Is this type of business dealing halal or haram? My father believes it is halal becuase he heard the hadeeth of Prophet (peace be upon him) where SAW said to a son you and your wealth belong to your father. Pleas advise.

In the case, if you have participated in your father's business with the intention of cooperating and serving, then your participation will be that of an assistant only and you will not have any share in the business or its profits.

And if you have joined as a formal partner as the question shows, you will also share in the profits according to the agreed proportion.

And if no form of distribution of profits has been agreed upon, then both (father and son) will be entitled to a share of the profits in proportion to their respective capital. In which case, simply because he is a son, he will neither be deprived of his profits nor his rights be handed over to his sisters without his permission. By doing so, the sisters do not become the owners of the brother's share, but the brother's rights remain only his.

Regarding the property purchased by your father with your money and then later credited to you, including an amount of loan on this property; not you but your father is actually responsible for paying the loan incurred on it. Now either you ask your father to settle this loan, or you pay it on your father’s behalf as a virtuous act or sell it at market price to solve this problem.

It is also not correct for your father to consider your wealth as his own by referring to the hadeeth: ’’انت ومالک لأبیک‘‘

The true meaning of this Hadeeth by learned scholars is that; if the father is poor and is in need of assistance, he is allowed to use his son's wealth, but that does not mean that the son's total accumulated capital belongs to the father.

Note: It should be noted that the answer is given on the assumption that you are involved in the business with your father with capital. If the capital involved in this business is entirely your own or if it is otherwise, please clarify for further details if required.

(إذا عمل أحد في صنعته مع ابنه الذي في عياله فكافة الكسب لذلك الشخص و يعد ولده معينا، كما أنه إذا غرس أحد شجرا فأعانه ولده الذي في عياله فيكون الشجر لذلك الشخص ولا يشاركه ولده فيه)

إذا عمل أحد في صنعة هو وابنه الذي في عياله واكتسبا أموالا ولم يكن معلوما أن للابن مالا سابقا فكافة الكسب لذلك الشخص ولا يكون لولده حصة في الكسب بل يعد ولده معينا وليس له طلب أجر المثل حتى أنه لو تنازع الأب في المتاع الموجود في بيته مع أولاده الخمسة الذين يقيمون معه في ذلك البيت وادعى كل منهم أن المتاع له فالمتاع للأب ولا يكون للأولاد غير الثياب التي هم لابسوها (التنقيح) ما لم يثبتوا عكس ذلك ويوجد ثلاثة شروط لأجل اعتبار الولد معينا لأبيه:

۱ - اتحاد الصنعة، فإذا كان الأب مزارعا والابن صانع أحذية فكسب الأب من المزارعة والابن من صنعة الحذاء، فكسب كل منهما لنفسه وليس للأب المداخلة في كسب ابنه لكونه في عياله.

وقول المجلة (مع ابنه) إشارة لهذا الشرط، مثلا إن زيدا يسكن مع أبيه عمرو في بيت واحد ويعيش من طعام أبيه وقد كسب مالا آخر فليس لإخوانه بعد وفاة أبيه إدخال ما كسبه زيد في الشركة، كذلك لو كان اثنان يسكنان في دار و كل منهما يكسب على حدة وجمعا كسبهما في محل واحد ولم يعلم مجموعه لمن كما أنه لم يعلم التساوي أو التفاوت فيه فيقسم سوية بينهما ولو كانا مختلفين في العمل والرأي 

۲- فقدان الأموال سابقا، إذا كان للأب أموال سابقة كسبها ولم يكن معلوما للابن أموال بأن ورث من مورثه أموالا معلومة فيعد الابن في عيال الأب

۳ - أن يكون الابن في عيال أبيه، أما إذا كان الأب يسكن في دار والابن في دار أخرى وكسب الابن أموالا عظيمة فليس للأب المداخلة في أموال ابنه بداعي أنه ليس للابن مال في حياة أبيه.

المتبرع لا يرجع بما تبرع به على غيره، كما لو قضى دين غيره بغير أمره( تنقیح الفتاویٰ الحامدیہ : (۲/۳۹۱)

’’عن عائشۃ قالت: افضل ما أکلتم کسبکم وان اولادکم من کسبکم ‘‘

قال محمد لا بأس بہ اذا کان محتا جا أن یاکل من مال ابنہ بالمعروف  فان کان غنیا فاخذ منہ شیئا فھو دین علیہ وھو قول ابی حنیفۃؒ محمد قال أخبرنا ابو حنیفۃ عن حماد عن ابراھیم قال لیس للاب فی  مال ابنہ شیئی الا ان یحتاج الیہ من طعام او شراب او کسوۃ قال محمد وبہ ناخذ وھو قول ابی حیفۃ ،( فی کنز العمال :۸؍۲۸۳)

عن الحاکم وغیرہ ان اولادکم ھبۃ اللہ لکم یھب لمن یشاء اناثا ولمن یشاء الذکور فھم وأموالھم لکم اذا احتجتم  علی تعلیل امام محمد قول عائشۃ  ان اولادکم من کسبکم بما اذا  کان محتاجا ویلزم  التقلیہ کونہ دینا علیہ اذا اخذ فی غیر حاجۃ  کما ھو ظاہر، قلت وایضا  فسر ابوبکر الصدیقؓ :بھذا قولہ علیہ السلام أنت ومالک لأبیک قال ابوبکر: انما  یعنی بذلک النفقۃ (رواہ البیھقی کذا فی تاریخ الخلفاء :۶۵) (ھکذا فی تعدیل حقوق الوالدین للتھانویؒ)

وفی القنیہ الأب وابنہ یکتسبان فی صنعۃ واحدۃ ولم یکن لھما شیئی فالکسب کلہ لأب ان کان الابن فی عیالہ لکونہ معینا لہ۔ (رد المحتار: ۶؍ ۳۹۲۔ بدائع الصنائع : ۳؍۴۴۰) (رد المحتار:۴/۳۲۵)
