Zaqat.

Asalamalakum.

I have another question regarding the Zaqat. My father gave me two land pieces, one he gifted me but both are under my name. Few days back I talked to him regarding the Zaqat and told him that if you think about land that was not gifted, as an investment so we have to pay the ZAQAT. As he gave me other land as a gift but as he is an elder, I also gave him authority letter to sell both the lands. O also asked him may be he has some thing else of investment in his mind but he said he was not thinking any thing. As I understand, he has not anything clear in his mind for both the lands. When I was talking to him It looked like that he has some other plans for both the lands but not for investment. As he is my father and back home we have joint family system, if he said to something else, I have to do that. But my Plan is different I want to build hotel on that land. Right now he has the sale deed under his name and he can sell both the lands any time, gifted one and the other one also.

I save $450 for the ZAQAT but I need it and used it so what should I do.

whats your point of view of paying ZAQAT on these land pieces?

الجواب وباللہ التوفیق

  1. Zakat is not obligatory on these two pieces of land.
  2. It should be noted that Zakat becomes obligatory on lands which are purchased  with the intention of selling that land. But if the land was not bought with the intention of selling, but was intended to be sold later, then Zakat will not become obligatory on those lands until they are sold. After the sale, Zakat shall be paid when a complete “Zakat Year” has  passed on this amount. Alternatively, when time is up for paying Zakat on your other moveable or immovable properties, Zakat on this saved amount can be combined as well.
  3. The money you have set aside for the intention of paying Zakat, but haven’t paid it yet, that money can be used for your other expenses. As long as it is not spent, you are allowed to use it in any expenditure of your choice. However, you should try to pay Zakat as soon as possible.
