الجواب وباللہ التوفیق

In answer to your question:

1. if the person is “Sahib-e- Nisab”, that is, he owns seven and a half tolas of gold or fifty-two and a half tolas of silver, or has in his possession other than the above-mentioned apartment, gold, silver, cash or merchandise, to the extent that fifty-two and a half tolas of silver can be purchased with it, It is not permissible to give Zakat to him.

2. But if those things are in such quantity that fifty-two and a half tolas of silver cannot be bought with those articles of value, then it is permissible to give Zakat to that person.

3. If he is not eligible for zakat but is however unable to afford his treatment with his available resources, and the treatment has become a necessity, then he should take a loan from someone, in such an amount that renders him eligible for zakat. He can then spend the borrowed money on his treatment. Since he has now become eligible for zakat, he should be given Zakat and he must pay his debt with that zakat  money.

’’ الزکوۃ واجبۃ فی عروض التجارۃ کائنۃ ماکانت اذابلغت قیمتہا نصابا من الورق والذہب ‘‘ … ( فتاویٰ الہندیۃ : ۱۷۹ / ۱ 

’’ والدفع الی من علیہ الدین اولی من الدفع الی الفقیر…فان کان مدیونافدفع الیہ مقدار مالوقضی بہ دینہ لایبقی لہ شیء اویبقی دون المأتین لابأس بہ ‘‘ … ( فتاویٰ الہندیۃ : ۱۸۸ / ۱ 

لقولہ تعالیٰ: انما الصدقات للفقراء والمساکین (سورۃ التوبہ:۶۰

عن ابن عمرؓ : عن النبی صلی اللہ علیہ وسلم: قال لا تحل الصدقۃ لفی۔(سنن الترمذی: ۱؍۱۴۱،رقم ۶۴۷

مصرف الزکاۃ ... ھو فقیر وھو من لہ ادنی شیئی  ومسکین من لا شیئی لہ۔ (در مختار مع الشامی :۳؍۲۸۳؍۲۸۴
