Three Talaq

Husband gave divorce to her wife over the phone by pressuring his family. He said three times mein tumhein talaq deita hoon , he said that three times but pronounced his wife’s last name wrong.  Then called again and pronounced his wife’s name right and said mein tumhein talaq deita hoon , mein tumhein talaq deita hoon. Mein  tumhein talaq deita hoon.  Then after a while he texted her and send two texts saying mein tumhein talaq deita hoon. He wrote it down three times and sent it to her.  Again one more text sayin same thing three times sent.  Next day one more text sent saying same thing.

Please let me know according to your knowledge is this talaq valid?


I also want to add that husband was saying before few days back that he will give her talaq some day but on that day he said they forced me to call her.

 الجواب وبالله التوفيق 

In the situation inquired about three Talaq (Divorces) have taken effect on you. There is no room for Rujoo’ (reconciliation) except that after Iddat you do Nikah with someone else and after establishing the matrimonial relationship if unfortunately he too gives Talaq (Divorce) to you and Iddat passes after that then Nikah can be done with the first husband again.

عن عائشة:أن رجلا طلق امرأته ثلاثا فتزوجت فطلق فسئل النبي صلى الله عليه و سلم أتحل للأول ؟ قال ( لا حتى يذوق عسيلتها كما ذاق الأول ) (صحیح بخاری:کتاب الطلاق:باب من اجاز الطلاق،۴۹۶۱)

عن سہل بن سعد رضي اللّٰہ عنہ في ہذا الخبر قال فطلقہا ثلاث تطلیقات عند رسول اللّٰہ صلی اللّٰہ علیہ وسلم فأنفذہ رسول اللّٰہ صلی اللّٰہ علیہ وسلم۔ (سنن أبي داؤد ۱؍۳۰۶ رقم: ۲۲۵۰)

وَإِنْ كان الطَّلَاقُ ثَلَاثًا في الْحُرَّةِ وَثِنْتَيْنِ في الْأَمَةِ لم تَحِلَّ له حتى تَنْكِحَ زَوْجًا غَيْرَهُ نِكَاحًا صَحِيحًا وَيَدْخُلَ بها ثُمَّ يُطَلِّقَهَا أو يَمُوتَ عنها كَذَا في الْهِدَايَةِ وَلَا فَرْقَ في ذلك بين كَوْنِ الْمُطَلَّقَةِ مَدْخُولًا بها أو غير مَدْخُولٍ بها كَذَا في فَتْحِ الْقَدِيرِ (فتاویٰ ہندیۃ:۱/۴۷۲)

(ویقع طلاق کل زوج بالغ عاقل ولو عبدا أو مکرہا۔ (الدر المختار ۴؍۴۳۸ زکریا)
